On 27 June 2022 the Danish Ministry of the Interior and Housing (in Danish: “Indenrigs- og Boligministeriet”) has put forward a draft bill which, if adopted, will lead to significant changes in the rules on pre-emption rights (in Danish: “tilbudspligten”) under the Danish Lease Act. The proposed changes will widen the scope of application and strengthen the legal position of the tenants when transferring rental properties and prevent the use of certain contracts- and corporate structures that circumvent the landlord’s obligation to offer the vacated units to the tenants.

 A key takeout point from the newsletter is that the draft bill in its present form will effectively put an end to the use of double holding structures when transferring rental properties subject to the pre-emption right rules
